Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your access to and use of the InMetrics mobile application and related services (the "Application" or the "Service"). By downloading, installing, accessing, or using the Application, you agree to these Terms. If you do not agree, do not use the Application.

2. Use of the Application

You may use the Application only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Application in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to systems, networks, or data related to the Application.
• Reverse engineer, decompile, or otherwise attempt to obtain the source code of the Application, except where permitted by law.
• Interfere with or disrupt the integrity or performance of the Application.

We may modify, suspend, or discontinue the Application (or any part of it) at any time without prior notice.

3. No Affiliation with Third Parties

InMetrics may provide analytics, insights, or tools related to third-party services (for example, social media platforms). We are not endorsed by, affiliated with, or officially connected to any third-party platform unless explicitly stated. All trademarks, service marks, and logos remain the property of their respective owners.

4. Limitation of Liability

To the maximum extent permitted by law, InMetrics, its owners, directors, employees, partners, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses arising out of or in connection with:

• Your access to, use of, or inability to access or use the Application.
• Any conduct or content of any third party on or through the Application.
• Any content, data, or information obtained from the Application.
• Unauthorized access to, use of, or alteration of your transmissions or content.

This limitation applies whether the claim is based on warranty, contract, tort (including negligence), or any other legal theory and whether or not we were advised of the possibility of such damages. Some jurisdictions do not allow certain exclusions or limitations; in those cases, our liability is limited to the fullest extent permitted by law.

5. Disclaimer of Warranties

Your use of the Application is at your own risk. The Application is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

• We do not warrant that the Application will be available at a particular time or location, or be uninterrupted or secure.
• We do not warrant that defects or errors will be corrected or that the Application will be free of viruses or other harmful components.
• We do not warrant that results obtained from using the Application will meet your expectations or requirements.

6. Purchases and Subscriptions

The Application may offer in-app purchases, subscriptions, or other paid features ("Purchases").

• Purchases are processed by the app store provider (such as Apple App Store or Google Play); their terms, conditions, and payment policies apply.
• Prices, subscription periods, and available features may change at any time subject to app store rules.
• Unless stated otherwise, subscriptions automatically renew at the end of each billing period; you may manage or cancel subscriptions through your app store account settings.
• We may refuse or cancel any Purchase for reasons including service unavailability, description or price errors, order issues, or suspected fraud or unauthorized activity.

If a separate subscription or refund policy applies, those terms operate in addition to these Terms.

7. Termination

We may terminate or suspend your access to the Application, without prior notice or liability, for any reason, including violation of these Terms. Upon termination, your right to use the Application ceases immediately. Provisions that should survive termination (including ownership, warranty disclaimers, indemnity, and liability limitations) continue to apply.

8. Changes to These Terms

We may revise or update these Terms from time to time. When changes are made, we will update the "Effective date" at the top of this page and may provide notice in the Application. Continued use after changes take effect means you accept the updated Terms; if you do not agree, stop using the Application.

9. Governing Law

These Terms and your use of the Application are governed by the laws of the jurisdiction where the operator of InMetrics is established, without regard to conflict of law provisions.
